As of October 1, 2011, cops in Nevada can stop you for texting or hand-holding a cellphone (or other wireless communications device) while driving. You will be given a warning until January 1, 2012, when tickets will start being issued. Fines for first, second, and third offenses are $50, $100, and $250 respectively. For those willing to pay and keep on texting, the next level is a $1000 fine and six month license suspension. As with other moving violations, penalties are double in work zones.
The law detailing cellphone use and driving is Senate Bill 140, passed by the 76th Nevada Legislature in 2011, only one of dozens introduced for action. To learn more about how SB 140 became law and many other proposals didn't, read my article about Nevada Laws and Statutes. This is a primer on how laws are enacted in Nevada and includes links to more information about statutes that may be of interest, such as Nevada prostitution, taxes, domestic partnership, liquor laws, and more.
