( #about ) Starting January 1, 2012, Nevada will join the majority of other states in issuing citations for handheld cellphone use while driving. However, starting October 1, 2011, officers will begin stopping and warning drivers observed violating the new rules established by the 76th Nevada Legislature in Senate Bill 140. Governor Sandoval signed the measure into law after the Legislature adjourned in June.
With certain exceptions, like calling 911 in an emergency situation, Nevada's new law bans holding and using a cellphone (or other communication device) to talk or text while driving. It is a primary law, which means that, like speeding, an officer needs no other reason to stop and cite drivers if cellphone use is suspected. Using a hands-free device to talk on a cellphone remains legal under the new law. Violations are misdemeanors and fines are $50, $100, and $250 respectively for the first three violations. Three violations within seven years will result in a drivers' license suspension of six months.
